Terms of Sale

1. Tax Lien Certificates

Howard County sells tax lien certificates rather than transferring immediate property ownership. The winning bidder receives a tax sale certificate that establishes rights under Indiana tax sale law.

2. Redemption Period and Investor Returns

Indiana generally allows property owners one year to redeem properties after the tax sale.

If a property owner redeems, the tax lien investor receives:

Within the first 6 months: The minimum bid amount plus a 10% penalty on that minimum bid.

After 6 months and within 1 year: The minimum bid amount plus a 15% penalty on that minimum bid.

Overbid Amount: The amount exceeding the minimum bid, plus 5% annual interest calculated from payment until redemption.

Subsequent Tax Payments: Reimbursement for qualifying taxes and special assessments the investor pays after the sale, plus 5% annual interest.

Indiana law also addresses certain eligible notice and title-search expenses. The 10% and 15% penalties apply to the minimum bid, not automatically to the entire winning bid.

3. If the Property Does Not Redeem

If the property owner does not redeem within the applicable redemption period, the certificate holder may pursue a tax deed through the court.

The investor must satisfy Indiana’s legal notice requirements and petition the court within the statutory deadlines. A tax lien certificate does not automatically transfer ownership when the redemption period ends.

4. Payment Requirements

Winning bidders must follow Howard County’s payment instructions and deadlines. Contact SRI Services or the County Treasurer to confirm acceptable payment methods and the final payment deadline before bidding.

5. Property Research

Bidders should examine property records, legal descriptions, existing liens, access, occupancy, environmental concerns, and other property conditions before participating. The county may remove properties from the auction when owners settle delinquent taxes.
