Terms of Sale

1. Premium Bidding System

Park County uses a premium bidding format for its tax lien auction. Bidding starts at the advertised delinquent tax amount, including applicable interest, fees, and other charges.

2. Tax Lien Ownership

Winning bidders purchase tax lien certificates, not real estate ownership. A tax lien certificate does not give investors the right to occupy, access, use, or improve the property.

3. Redemption and Treasurer’s Deed

Park County tax liens remain valid for seven years from their original issue date. After three years, eligible certificate holders may pursue the statutory public auction process for an option for a Treasurer’s Deed.

The process does not guarantee property ownership. Colorado law requires additional procedures, and property owners retain applicable redemption rights.

4. Payment Terms

Park County accepts ACH bank debit as the only payment method for winning auction bids.

The county initiates ACH payment within 24 hours after the final batch closes. Bidders must maintain sufficient funds and provide accurate banking information.

A batch summary does not serve as the final invoice. Failed or rejected payments may result in bid cancellations under Colorado law.

5. Buyer Responsibility

Park County conducts its tax lien sale under buyer-beware conditions. Investors must research property records, legal descriptions, access, title issues, and other risks before bidding.

Colorado law also restricts certain county officials, employees, immediate family members, and agents from acquiring tax liens under C.R.S. 39-11-151.
