Two Very Different Sales Happen in Waupaca County, Wisconsin

Waupaca County actually runs two kinds of sales, and mixing them up is a common mistake.

Tax deed sale. This comes from unpaid property taxes. The County Treasurer runs it using a legal process called In Rem foreclosure. It uses sealed, written bids, not a live auction.

Sheriff’s sale. This comes from an unpaid mortgage, meaning a bank sued a homeowner. The Sheriff’s Department runs this one every Tuesday at 10:00 a.m. in the front lobby of the Waupaca County Courthouse, 811 Harding Street, Waupaca, Wisconsin. Why Waupaca County Wisconsin Never Sells “Tax Liens”

Some states let an investor buy a debt certificate and collect interest while they wait. Wisconsin does not work that way. Waupaca County takes full ownership of the land first, through the courts, and only then sells the actual property. There is no certificate to buy and no interest payment involved. That full transfer is why people call this a tax deed, not a lien.

How a Property Reaches Sale Day

  1. An owner stops paying real estate taxes.
  2. Taxes stay unpaid long enough for the county to start an In-Rem foreclosure under Wisconsin Statute 75.521.
  3. The county publishes a Class 3 notice, meaning it runs once a week for three straight weeks in the county’s official newspaper.
  4. Waupaca County takes full legal title once the court process finishes.
  5. The county opens the sale to sealed bids from the public.

How to Place a Sealed Bid in Waupaca County Wisconsin

Bidding on tax deed land here is a paperwork process, not a bidding war in a room. Follow these steps in order.

  1. Watch for the Sale of In Rem Tax Foreclosure Property notice from the county.

  2. Read the terms and conditions listed with that notice.

  3. Fill out every line of the Waupaca County Bid Form completely.

  4. Get a certified check, money order, or cashier’s check for at least 10% of your bid amount. Make it payable to the Waupaca County Treasurer.

  5. Put one bid form and one payment in each envelope. Bidding on two properties means two separate envelopes.

  6. Write “Sealed Land Bid” plus the parcel number on the outside of the envelope.

  7. Deliver it to the Waupaca County Clerk, 811 Harding Street, Waupaca, WI 54981, before the date and time on the notice.

  8. Show up at the public bid opening if you want to watch, or wait for the county to contact you.

Every property sells “as is.” Nobody at the county fixes a roof, clears out junk, or settles a boundary fight before you take ownership. Do this homework first:

  • Pull the parcel’s tax and ownership history through the county’s property search tools.
  • Contact the Register of Deeds to check for old liens still tied to the land.
  • Call the local town, village, or city to confirm zoning and legal use.
  • Drive by the property. Interior access almost never gets offered.
  • Set aside extra money for repairs, cleanup, or surprise costs.
  • For Sheriff’s sale properties, direct condition and title questions to the attorney named on the sale notice, since the bidder is responsible for finding back taxes, liens, or judgments.
