FAQs

Can I see the interior of the house?
No. Properties purchased at the Sheriff’s Sale are not available for inspection. The defendant in a foreclosure action is still the legal owner of the property. The Allen County Sheriff’s Office does not have access to the properties for sale, including the interiors. If someone attempts to view the property without the owner’s permission, they violate the Ohio Revised Code’s Criminal Trespassing law.

Do I receive a clear title?

The Allen County Sheriff’s Office does not guarantee a clear title. A title search is recommended.

What happens to the liens on the property?

The sale proceeds marshal the liens by placing and paying them in order. If the sale doesn’t generate enough money, the court grants a Deficiency Judgment to the Plaintiff (lien holder) against the Defendant (homeowner). The property cancels the liens, except for Federal Liens, which remain.
