Terms of Sale:

Registration Requirement: Bidders must register before the auction starts by presenting a valid government-issued ID. The grantee on the deed must match the name of the registered bidder (Texas Tax Code, Section 34.015).

Payment Terms: Winning bidders must pay immediately using cash or a cashier’s check made payable to the designated payee. Failure to pay will result in liability for 20% of the property’s value plus additional costs (Texas Rules of Civil Procedure, Rule 652). Those bidding on behalf of an entity (e.g., corporation, LLC) will be personally liable if the entity fails to pay.

Minimum Bids and Additional Taxes: They outline Minimum bids on the bid sheet and include taxes owed as of the judgment date. Additional taxes incurred after judgment are the buyer’s responsibility.

Deed and Title Information: Buyers receive a Sheriff’s Deed with no warranty, express or implied. Title insurance may be challenging to obtain, and Stephens County does not guarantee the title.

Redemption Rights: Properties are subject to a statutory redemption period. For homestead, agricultural land, and mineral properties, the period is two years; for other properties, it is 180 days. Redemption terms include a premium of 25% in the first year and 50% in the second year.
