Upshur County Tax Sale Information

Gladewater Independent School District and the City of Gladewater, Upshur County, Texas, will host a Delinquent Property Tax Sale on October 7, 2025. The auction will be held under the entrance canopy at the Upshur County Justice Center, located at 405 North Titus, Gilmer, Texas 75644, and bidding will commence at 10:00 a.m.

Terms of Sale:

Registration Requirements: Individuals wishing to bid on property at the sale must register with the Linebarger representative attending the sale prior to the start of the sale, providing a valid government-issued ID. The deed will only be made out to the individual or entity name registered at the time of the auction.

Payment: Winning bids must be paid with a money order or cashier’s check made payable to Linebarger Law Firm. Failure to pay will result in a penalty equal to 20% of the property’s value plus any incurred costs, as outlined by Rule 652 of the Texas Rules of Civil Procedure.

Deed and Title Information: Successful purchasers will receive a Sheriff’s Deed, issued without warranty. Obtaining title insurance may be challenging.

Right of Redemption: A statutory right of redemption applies—two years for homestead and agricultural properties and 180 days for other property types. Right of possession begins 20 days after recording the deed with the county.

Minimum Bid: The bid sheet lists the minimum bid for each tract, which covers delinquent taxes up to the judgment date. Any subsequent taxes will be the purchaser’s responsibility.

Delinquency Clearance Requirement: Buyers must obtain a written statement from the Upshur County Tax Office confirming that they do not owe any delinquent taxes to the county or any local district before they receive the deed to the property.

How to Participate:

Research each property at the County Clerk, Appraisal District, or District Clerk’s offices for deeds, plats, and lawsuit documents. Buyers must verify property locations and conditions as all sales are “AS IS.”

Redemption Costs: Redemption costs will include the purchase amount, deed recording fees, and any additional taxes paid, plus a 25% premium if redeemed within the first year and a 50% premium in the second year. Costs are strictly for necessary maintenance and safekeeping.
