Terms of Sale:

Bidders must be 18 or older. Every bid creates a legally binding and irrevocable offer. Tooele County requires full payment within three business days of the Notice of Award, and buyers must pay by wire transfer only. The county does not accept cash, checks, or money orders. If you win more than one parcel, you must pay for all awarded parcels in full because Tooele County does not allow partial payments.

Public Surplus adds an 8% buyer’s premium to the winning bid. Tooele County sells every parcel AS IS, WHERE IS, WITH ALL FAULTS by Tax Deed, not by warranty deed. The county does not guarantee title, marketability, condition, zoning, access, utilities, environmental status, or the accuracy of the legal description. Tooele County allows redemption up to the start of the auction. Once the auction starts, Utah law does not allow redemption by the owner, although the terms note that the IRS may have a 120-day redemption right and active-duty military protections may apply. After sale ratification, Tooele County records the tax deed, usually within 30 to 90 days, then mails it to the buyer. The buyer must handle lawful possession.
