Hays County will host its Delinquent Property Tax Sale on Tuesday, December 2, 2025, at the South door of the Hays County Government Center, located at 712 S. Stagecoach Trail, San Marcos, TX 78666. The sale begins promptly at 10:00 a.m. with bidder registration required beforehand.

Terms of Sale:

Registration Requirement: All bidders must register with the auction official before the sale begins and present a valid government-issued ID. The grantee on the deed must match the registered bidder’s name (Texas Tax Code, Section 34.015).

Payment Terms: Winning bidders must pay immediately with cash or a cashier’s check payable to Hays County Constable, Pct. 1. If payment is not made, the bidder will be liable for 20% of the property’s value plus additional costs per Rule 652 of the Texas Rules of Civil Procedure.

Minimum Bids and Additional Taxes: Minimum bids include delinquent taxes up to the judgment date but do not cover the current tax year. Buyers must pay all subsequent taxes.

Deed and Title Information: Purchasers will receive a Constable’s Deed without warranty. Title insurance may be difficult to secure, and Hays County makes no title guarantees.

Redemption Rights: Properties are subject to a statutory redemption period. For homesteads, agricultural land, and mineral properties, the period is two years; for other properties, it is 180 days. Redemption terms follow Texas Tax Code guidelines, including a premium of 25% for the first year and 50% for the second.

How to Participate:

Register Early and Bring ID: Arrive early to register with a valid ID. The grantee on the deed must match the name on your ID.

Conduct Property Research: Review legal descriptions, maps, and plats available at the County Clerk’s office or Appraisal District to verify property details. All properties are sold “AS IS” and buyers are responsible for due diligence.

Prepare Immediate Payment: Successful bidders must be ready to pay the bid amount immediately after the sale with cash or cashier’s check.
